Sandpiper Management & Vacation Rentals LLC

ADDRESS: The rental property address is clearly stated in the listing. It is additionally listed in the welcome packet.

 

CONTACT INFORMATION: GUEST agrees to provide their full legal name, mailing address, email address, and phone number as part of the reservation information. GUEST recognizes that they may need to provide a copy of their Driver’s License or another form of government issued identification.

 

PROPERTY: The property is furnished and includes dishes, utensils, bed linens for each bed, and bath towels. Beach towels are not included in your stay. Please do not use bath towels or blankets from the property for this purpose.

 

OCCUPANCY: Guest acknowledges and understands that s/he is a licensee of the Owner and not a GUEST, and is not acquiring any interest in the property.

 

MAXIMUM OCCUPANCY: Guest agrees that the Property shall not be occupied by more than the number of people stated in the Agreement. The Property can not be occupied by more than the maximum number of people can comfortably sleep. Maximum occupancy for this property is listed in the online listing and is based on safety, comfort, and town regulations. Occupancy refers to the total number of adults and children.

 

CHECK-IN & CHECK-OUT TIMES: The lease begins at 4:00pm on the date of your stay. Check In is at 4:00 PM on the day of your arrival. We do not require that GUEST physically check-in or check- out. All of our properties have a door keypad or a lockbox that contains the key or a door keypad to access the property. We will provide a code upon payment in full. We ask that GUEST please respect our housekeeping and inspection staff by not arriving before check-in time or leaving after the check-out time without prior consent from Sandpiper Management & Vacation Rentals, LLC. We cannot be accountable for the cleanliness or condition of the property if access to the property is attempted prior to check-in time. If premises appear unclean or damaged in any way, guests should advise Sandpiper Management & Vacation Rentals, LLC immediately. Check out is no later than 10:00 AM on the day of your departure. A timely check-out is necessary in order to facilitate housekeeping services for the next guests arriving.

 

MINIMUM STAY: Each property requires a minimum stay of nights depending upon the time of year and the agreement Sandpiper Vacation Management & Rentals has made with the owner.

 

PAYMENTS: Unless otherwise set forth below, for reservation made more than 60 days in advance, a 1/2 deposit is due with the executed Agreement. Payment in full is due 60 days prior to arrival. For reservations made within 60 days, payment is full is required with the signed Agreement. Acceptable payment methods are personal check (if Arrival Date is greater than 14 days), money order, or credit card or debit card. Please make checks payable to Sandpiper Management & Vacation Rentals, LLC.

 

USE OF PROPERTY: It is understood and agreed between the parties that the Property shall be used and occupied for leisure and vacation only and for no other purpose. Guest agrees that it will not use or permit any person to use the premises for any use or purpose in violation of the laws of the United States, the State of South Carolina, or of any other lawful authorities. Guest and all other occupants will be required to vacate the Property immediately, with no refunds, for any of the following violations: (a) Use of Property for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to any person less than 21 years of age; (b) consumption or use of any illegal substances; (c) loud music (when a complaint has been made from neighbors) and/or disruptive behavior, (d) causing damage to the Property or to any neighboring properties; (e) any other acts which may interfere with the neighbors’ quiet enjoyment of their Property. Children MUST be supervised at all times.

 

CONDITION OF RENTAL: Guest agrees to keep the property and all furnishings in good order. Guest agrees to only use appliances for their intended use.

 

PROPERTY MAINTENANCE: Guest agrees that Owner and its Agent(s) may enter the premises for the purposes of effecting necessary repairs and/or maintenance or for other necessary purposes. All responsible efforts will be made to handle maintenance emergencies; however, no guarantee can be made that such problems can be resolved immediately. Please notify Owner’s Agent or Owner of any maintenance needs during your stay as soon as practicable, so repairs can be made in a timely manner. No refunds will be given for any issues unless it is necessary for Guest to vacate the premises. All housekeeping issues must be reported on your date of arrival.

 

SMOKING: Smoking on the premises is strictly prohibited. A violation of this policy may result in a termination of this Agreement wherein guests will be required to vacate the premises immediately with no refund. Guest will be held responsible for any additional damage and a $300 additional cleaning fee.

 

WASHER / DRYER: A washer and dryer is located on premises.

PROPANE AND CHARCOAL GRILLS: Please note that not all properties allow or offer gas/ propane or charcoal grills. If your rental property does, please take care to use safely. We are not responsible for the type or condition of a grill at a particular property. We are unable to tell if a propane tank is full or not. If the tank is empty, please contact Sandpiper Management to exchange the tank. When in operation, grills must be pulled away from the walls of the property. Please ensure that coals are extinguished and the grill is left clean for the next guest.

 

INTERNET CONNECTIVITY ACCESS: Properties offer either high-speed internet access or WiFI access. These services are provided but not guaranteed. Although reasonable efforts will be made to ensure that internet connectivity is working during the guest’s stay, no refunds are offered for service that is interrupted or unavailable.

 

PETS: The vacation rental pet policy varies per property. Dogs are allowed ONLY in pet friendly properties. Guests shall not bring any pets onto the property, unless with prior approval of the OWNER. Pets are not allowed on or in the Property without the express, written consent of Sandpiper Management & Vacation Rentals, LLC. If guest has been given permission to bring a pet on the property, the Guest must: Pay a nonrefundable fee per pet, per property. Keep pet safe from wild animals or injury from conditions of Property. Clean up after pet inside and outside the Property; Keep the pet off the furniture, or cover the furniture with Guest’s own linens to protect it from pet hair and stains.

 

SPEED LIMIT: A maximum speed limit of 25 mph or less is strictly enforced. Please use caution when driving around the island.

 

QUIET ENJOYMENT: There is a quiet enjoyment curfew on Seabrook Island from 10:00 PM to 8:00 AM.

 

LOCAL ORDINANCES AND RULES: Guest agrees to abide by all the Town of Seabrook Island ordinances and the rules and regulations of the Owner and Property Owners Association, including those set forth above. Owner has the right to terminate this agreement and ask the violators to vacate. No refund will be given for the time remaining in the reservation.

 

PARKING: Parking is limited to the number of vehicles specified. LSV vehicles count as a vehicle in the maximum vehicles allowed. Vehicles are to be parked in driveways or designated parking areas only. Parking on the road is not permitted. Parking space are not designated by address. Any illegally parked cars are subject to fines and/or towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

RVs, TRAILERS, BOATS, CAMPERS AND MOTORCYCLES: Motorcycles, campers, boats, trailers and RVs are not allowed. If GUEST wishes to bring any of these types vehicles, please contact the Seabrook Island Security Gate in advance of your scheduled stay to arrange access to the secure parking area near the Island Recycling Center. Their phone contact number is 843-768-6641.

 

DAILY AND MID-STAY HOUSEKEEPING: Housekeeping after your check-in and prior to your departure is not provided unless arranged in advance. Daily or mid-stay housekeeping fees will result in an added charge.

 

KEYS: If any guest locks themselves out of the property and must call the Property Manager for entry, there will be a lock out fee of $95 assessed. In addition there is a $25 fee for each lost key. A key is to be returned to the lockbox at the time of checkout.

 

AMENITY CARDS: Amenity cards are necessary to access the Seabrook Island Club facilities and amenities and The Lake House facilities. Some properties offer paid access to these amenities, while others do not. Each vacation rental property listing defines this information within the listing details. All Seabrook Island property owners and their rental guests have access to The Lake House facilities. Access to the outdoor pool is free of charge and the GUEST can get a free access card at the Amenity Office that is only good for use at the Lake House outdoor pool keypad. There are daily, per person charges to use the indoor pool, fitness center, or attend exercise classes. This is not part of The Seabrook Island Club amenities as it is owned separately by the Seabrook Island Property Owners Association (SIPOA). GUEST may call the Amenity Office at (843) 768-3942 to get information on the individual charges for the Lake House facilities.

If a property owner is a member of the Seabrook Island Club, their rental guests have access to the Club amenities at a cost of $50 per day per family or it is included in the rental cost (as this varies by property). The Seabrook Island Club does not accept cash or credit cards nor offer access to visitors who do not have an Amenity Card. The Amenity Card will be connected to a credit card number GUEST provide to the Amenity Office at the time GUEST orders your amenity cards online or when GUEST picks them up at the Amenity Office. It is to be noted that the Amenity Card Office and Seabrook Island Club are separate from Sandpiper Management & Vacation Rentals, LLC. Sandpiper Management & Vacation Rentals, LLC cannot be held responsible for the quality or availability of these services.

 

UNAVAILABILITY OF PROPERTY: If the property becomes unavailable prior to the guest’s stay, the guest is entitled to a refund not to exceed the amount paid by the Guest under the terms of the Rental Agreement.

 

CANCELLATIONS AND REFUNDS: *60 + days prior to your arrival date: Guest will receive refund of advance payment less $50 cancellation fee. *60 days or less prior guest arrival date: All rents and taxes paid shall be forfeited. No refund will be given. No shows, late arrivals and early departures are non-refundable. No refunds shall be provided for early departure, malfunctions in equipment (i.e., televisions, stereos) or weather conditions.

 

RETURNED CHECKS: There is a $30 fee for any returned check.

 

INCLEMENT WEATHER: There is no refund for inclement weather. In the event of a mandatory evacuation due to a named storm, all guests will be required to evacuate, and a pro-rated portion of the rental will be refunded. If a storm does approach and an evacuation order has NOT been given but guests elect to stay, owner reserves the right to make storm preparations (i.e. board windows/doors, etc.) as necessary.

 

AVAILABLE INSURANCE: To protect against cancellations caused by certain unforeseen events, such as illness, death, natural disasters, etc., we recommend that guests purchase trip cancellation and Interruption Protection insurance to assure refund of deposits paid and reimbursement of other vacation payments. Such insurance is available through travel agents, auto clubs such as AAA, or online at http:// www.rentalguardian.com.

 

ACCURACY OF INFORMATION: Every attempt has been made for accuracy. Owner and Property Owner Services, LLC is not responsible for errors on the website. Rate and policies are subject to change without prior notice.

 

LIMITATION OF LIABILITY: Under no circumstances shall Sandpiper Management & Vacation Rentals, LLC or Owner be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by Sandpiper Management & Vacation Rentals, LLC or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; Sandpiper Management & Vacation Rentals, LLC, at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. Sandpiper Management & Vacation Rentals, LLC will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Some activities in which guests engage are especially dangerous and include swimming, snorkeling, deep-sea fishing, boating, golfing, swimming, boogie boarding, surfing, kayaking, and biking. This list is not all-inclusive, but indicates some of the hazards of vacationing in South Carolina. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, decks with spaces between rails (dangerous for little children or small pets), unfenced lakefront, alligators, faulty electrical or plumbing systems, gas BBQ grills, clean/clear sliding glass doors, and dangerous stairs or pathways, Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this vacation home, cottage, townhome, condo or villa, GUEST acknowledges that in all events and circumstances, Sandpiper Management & Vacation Rentals, LLC, its officers and representatives shall not be liable. Sandpiper Management & Vacation Rentals, LLC reserves the right to cancel or rescind any rental agreement if it is found that the Guests are conducting unlawful activities, not abiding by the Seabrook Island Property Owners Association Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, are smoking in the property, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement.

 

ASSUMPTION OF RISK AND RELEASE, WAIVER, DISCHARGE, INDEMNITY AND COVENANT NOT TO SUE: The Guest, for him/herself, his/her heirs, administrators, personal representatives and assigns, and on behalf of all family members including and on behalf of minor children and occupants of the Property (collectively, the “Releasing Parties”): Guest fully understands and appreciates the dangers, hazards, and risks inherent in all encompassing activities in, on, and around the Property, including transportation to and from the Property (collectively, the “Activity”), and having fully considered such dangers and risks, in reliance on personal judgment, has voluntarily chosen to participate in the Activity; (a) Agrees to assume all the risks and responsibilities surrounding participation in the Activity, and releases, waives, forever discharges, and covenants not to sue the Owner, Agent, its officers, agents, employees, the assigned caretakers of the Property, and any students acting as employees and/or volunteers (referred to as the “Releasees”), from and against any and all liability for any harm, injury, damage, claims, demands, actions, causes of action, costs, and expenses of any nature that occurs or that may hereafter accrue, arising out of or related to any loss, damage, or injury, including but not limited to suffering and death, that may be sustained personally by one or more Releasing Parties or by any personal property belonging to one or more of the Releasing Parties, while in, on, upon, or in transit to or from the premises where the Activity, or any adjunct to the Activity, occurs or is being conducted, whether caused by the negligence or carelessness of the Releasees or otherwise; (b) Expressly intends that this Release shall bind all heirs, administrators, personal representatives and assigns, and all family members, including and on behalf of minor children, of the Releasing Parties, and shall be deemed as a “Release, Waiver, Discharge and Covenant Not to Sue” the above-named Releasees; (c) Agrees to save and hold harmless, indemnify, and defend Releasees from any claim by one or more of the Releasing Parties, or their spouses, family members, including and on behalf of minor children, their estates, heirs, administrator(s), personal representative(s), or assigns arising out of the participation of the Releasing Parties in the Activity; State that there are no health-related reasons or problems which preclude or restrict the participation of any of the Releasing Parties in the Activity (other than those restrictions which have been previously disclosed pursuant to a previous request for reasonable accommodations for this Activity); (d) State that the Releasing Parties have adequate health insurance necessary to provide for and pay any medical costs that may be attendant as a result of injury; and (e) Understands and agrees that Releasees will not have a telephone or medical personnel available at the location of the Property, or within close distance. (f) Miscellaneous. The laws of the State of South Carolina shall govern this Agreement in all respects.

ACKNOWLEDGEMENT: It is hereby agreed that unpaid rent, excessive cleaning, or non-accidental damage may be charged to the credit card on file if necessary. IN REVIEWING THIS DOCUMENT, GUEST ACKNOWLEDGES, FOR MYSELF, MY HEIRS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, AND ASSIGNS; AND ON BEHALF OF ALL FAMILY MEMBERS including and on behalf of minor children AND OCCUPANTS OF THE PROPERTY DESCRIBED HEREIN, THAT I, THE GUEST,HAVE CAREFULLY READ AND UNDERSTAND THE TERMS OF THIS AGREEMENT, INCLUDING THE “ASSUMPTION OF RISK AND RELEASE, WAIVER, DISCHARGE, INDEMNITY AND COVENANT NOT TO SUE” CONTAINED HEREIN; THAT THESE TERMS ARE CONTRACTUAL AND NOT A MERE RECITAL; THAT THE ONLY PROMISES MADE TO THE GUEST ARE THOSE STATED HEREIN; THAT THE GUEST HAS BEEN GIVEN SUFFICIENT TIME TO REVIEW THIS AGREEMENT; AND THAT THE GUEST AND OWNER ARE ENTERING INTO THIS AGREEMENT KNOWINGLY AND VOLUNTARILY, WITHOUT ANY COERCION, AND WITH THE FULL INTENT OF BEING BOUND BY ITS TERMS AND WAIVING CERTAIN LEGAL RIGHTS. THE GUEST IS AT LEAST 21 YEARS OLD, AND WILL NOT CONDONE UNDERAGE (UNDER 21) DRINKING AT THE PROPERTY IN ANY FORM.
